AGREEMENT BETWEEN CUSTOMER AND DOCTORBNB 

Welcome to the Doctorbnb.com website (the "Website"). Doctorbnb. (“Doctorbnb”) is a service portal, that provides general information regarding medical conditions and diagnoses, treatments, clinics and private practices which also, promotes transparency in healthcare pricing and unbiased health information services with an aim to offer consumers more choices on how they govern their healthcare.  DoctorBnB does not refer patients to any HealthCare Provider and does not charge any Healthcare Provider to be listed on the DoctorBnB Healthcare Marketplace at  (“DoctorBnB.com”).

The terms "we", "us", "our" and "DoctorBnB" refer to DoctorBnB. The term "you" refers to the customer visiting the Website and/or booking an appointment through us on this Website, or through our customer service agents. 

By accessing or using this Web Site and/or associated services, you explicitly agree to comply with and be bound by these terms and all conditions or policies incorporated by reference herein. The agreement so entered into (and incorporating all these terms and conditions) shall be governed by the laws of France. This agreement and its terms shall prevail over any other terms, conditions or information inconsistent therewith, whether found on this Web Site or otherwise. We may assign the agreement at any time to any affiliated company, or as part of the sale to, merger with, or other transfer of our company to another entity. You hereby agree to bring any disputes concerning the agreement exclusively before the courts and of France and you hereby irrevocably submit to the jurisdiction of these courts. If you do not agree to all these provisions, do not use this Web Site or any associated services. Be sure to return to this page periodically to review the most current version of the Agreement. We reserve the right at any time, at our sole discretion, to change or otherwise modify the Agreement without prior notice, and your continued access or use of this Website signifies your acceptance of the updated or modified Agreement. 

Doctorbnb does not recognize Terms of Use or Special Terms and Conditions sent by the customers; these conditions are not part of the agreement between the parties, unless explicitly confirmed by DoctorBnB. 

This website does not provide medical advice: by accessing, using or browsing this site, you indicate that you have read, understood and agree to be bound by this terms and condition, and that you understand and intend this user agreement to be the legal equivalent of a signed, written and binding contract between you and DoctorBnB. 

When you use this Web Site or any associated services, we may collect, store and use certain information as described in the section entitled “Privacy Policy” below. If you do not agree to such provisions, do not use this Web Site or any associated services. 

Services offered by DoctorBnB 

SECOND OPINION SERVICE 

If you are paying to DocotorBnB online medical second opinion service through your credit card, DoctorBnB reserve's the right to accept payment from your credit card. By requesting the credit card payment option, you hereby authorize us to bill and charge the amount indicated in your order via secure payment system, which shall debit the applicable amounts from your credit card. 

You can expect to receive your DoctorBnB online medical second opinion dossier within 7 business days after we have received your payment and all the medical information needed to be able to provide a detailed digital medical dossier. The Customer agrees that only medical staff responsible for your care and will have access to the medical dossier. 

The Customer should have obtained primary care from a local medical professional before using DoctorBnB online Second Opinion. DocotrBnB's online second opinion is not intended to replace a full medical evaluation or an in-person visit with a physician.The Customer can choose to see the second opinion doctor in person upon their availability if the medical case cannot be done remotely even by obtaining all the necessary medical records. 

The Customer can provide medical records on behalf of a third party, by prior notification to DoctorBnB, stating that the third party is a family member of the Customer and the Customer has prior consent from the third party to represent him and, the third party is not able to send a request via the portal by him/herself. 

Medical staff may at any time review the Customr’s medical records from prior to and after your interaction with the portal. Medical staff may request additional medical records and may review these records to better understand the course of treatment for Customer’s condition(s) including information regarding outcomes and costs, and to improve treatments and recommendations. 

After receiving a complete and accurate documentation, Case Manager will gather the Customer’s medical records and will create a Medical Case file. Case Manager will match the Customer’s Medical Case file with up to 2 different Doctors in our network of Providers, according to the specialty which the Customer diagnosis falls under. The Customer can choose which physician will provide the Customer with online second opinion report from the up to 2 Doctors shortlisted by Case Manager. Then, Case Manager will collect the complete medical records and will confirm the Customer via email once the full Medical Case file is ready to be sent. 

Once we receive payment, DoctorBnB will incur costs and engage with the relevant specialist doctors and hence from that moment onwards you will no longer be able to cancel the service and request reimbursement of your payment. 

REQUEST FOR AN APPOINTMENT OR AN OPERATION 

If a customer opts for a hospital stay or for a medical treatment, DoctorBnB accompanies him or her before, during and after treatment, helps him or her with any problems with the clinic, provides him or her with further information about accommodation, etc. 

Customer should pay the administrative fees through Paypal or Bank transfer, (see Pricing section for administrative fees). Once we receive payment, you will get an answer from DoctorBnB’s team within 3-4 days with an appointment’s date and the price of your consultation depending on your pathology and hospital’s choice. 
If the Customer contacts a hospital, clinic or private practice of his or her choice and signs the contract for medical services, this contract is concluded only between the customer and the clinic. DoctorBnB is not responsible for these contracts, their contents and their implementation. 

The cost of your treatment will be determined with your hospital after full analysis of your medical file. 
You agree that the Healthcare Provider has the right to cancel the healthcare procedure at any time and for any reason is the sole and absolute discretion of the Medical Professional. 

You can cancel your appointment prior to 48 hours before the appointment date via the DoctorBnB website. Before you make any changes or cancellations, please check the rules and restrictions associated with the third party healthcare or product/service provider to determine whether you can receive a refund. The rules and restrictions are detailed of your appointment confirmation e-mail you received from DoctorBnB. Please note that some healthcare procedures are fully non-refundable from the time the appointment is made. Additionally, many health care providers will generally charge a fee if cancellation occurs within 48 to 24 hours of the scheduled appointment. Rules vary by country and health care provider, so it is important to check the rules associated with your appointment.  You must request a refund directly with the third party health care provider.  They will issue a refund in accordance with their policies via the same payment method you used to book the appointment.  


Additional Services 

Doctorbnb reserves the right to offer certain additional services (for example, translation services, services for uploading and saving documents, case management, transfers, on-site medical interpreter, remote second opinion, etc.) per customers request. These additional services are regulated by Doctorbnb’s Special Terms and Conditions. In the event of any conflict between the Terms and Conditions and the Special Terms and Conditions, the Special Terms and Conditions shall prevail. 


DISCLAIMER 

We do not provide medical services, medical advice or healthcare services of any sort, and nothing stated or posted on this Web Site should be interpreted as such. We do not recommend or endorse any Advertiser. If you rely on any information posted on this Web Site, you do so solely at your own risk. 

You agree to assume all responsibility in connection with choosing any doctor for your desired procedure. We assume no responsibility or liability for any treatment or other services rendered by any doctor, or for any malpractice claims and other claims that may arise directly or indirectly from any such advice, treatment or other services. 


Termination of Your Account 

You acknowledge that if you violate the terms of our Legal Terms, DoctorBnB reserves the right to terminate your account without notice. You may also voluntarily terminate your account. You understand that if your account is terminated, you will lose access to our Service and any Member Content you have provided. You understand that we are not required to provide you with copies of such Member Content nor continue to maintain copies of such Member Content on our Service. 

INDEMNITY 

You agree to indemnify, defend and hold harmless DoctorBnB and our partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information and documents, attorneys, advertisers, product and Service providers, and affiliates, from any liability, loss, claim and expense, including reasonable attorney’s fees, related to your violation of our Legal Terms or your use of our Service. 

Take Down Notice 

If you believe that the materials we host infringe on your copyright, you may send us a notice, requesting that we remove or block access to the infringing material, which should include the following information: 
a description of where the material that you claim is infringing is located on the Web Site; 
an electronic or physical signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed; 
identification of the copyrighted work claimed to have been infringed; 
a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and 
a written undertaking by the copyright owner will undertake to compensate us any damages, loss or liability arising from our compliance of such notification.

We may collect billing information from treating Physicians, Clinics, and Hospitals as part of our effort to provide price transparency and for billing purposes. 

If you wish to arrange a consultation with a Healthcare Provider, then you will be asked to provide certain information including details such as your contact details (e.g. name, phone number and email address), age, country, and gender and some medical information to allow us to present your data to Healthcare Providers who may be interested in providing Medical Services to you. You warrant and undertake that the information provided by you is up-to-date, accurate in all material respects, not the confidential property of others or in violation of any third party’s rights, and is sufficient for us to facilitate the Website Services. We will take appropriate measures, consistent with industry practices, to protect information collected, to prevent unauthorized access, maintain data accuracy and ensure correct use of information.
